RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT
Organization: KL Tennis (hereinafter referred to as “KL Tennis,” “we,” “us,” or “our”)
By signing this document, you (and on behalf of any minor participant) acknowledge the risks associated with participating in tennis lessons, clinics, camps, drills, matches, tournaments, private instruction, group activities, or any related tennis programs and events organized or operated by KL Tennis (collectively, the “Activities”) and agree to the terms below.
1. Acknowledgment and Assumption of Risks
Participation in the Activities involves inherent and foreseeable risks including bodily injury, illness, permanent disability, paralysis, death, strains, sprains, fractures, heat-related illness, dehydration, slips, trips, falls, collisions, equipment failure, travel risks, and other unforeseen circumstances. I voluntarily assume all such risks, known and unknown, and accept full responsibility for any injury, loss, damage, or death that may occur.
2. Release of Liability and Waiver of Claims
I release and waive any claims against KL Tennis, its owners, directors, officers, instructors, coaches, employees, agents, volunteers, contractors, facility operators, sponsors, and affiliates (the “Released Parties”) arising from participation in the Activities, whether caused by negligence or otherwise.
3. Indemnity Agreement
I agree to indemnify and hold harmless the Released Parties from any claims, damages, costs, or expenses arising from participation in the Activities.
4. Medical Authorization and Fitness Representation
I authorize emergency medical treatment if necessary and accept responsibility for associated costs. I represent that I am physically fit to participate.
5. Photo/Video Release
I grant permission to photograph or record participation for promotional purposes without compensation.
6. Governing Law and Severability
This Agreement shall be governed by the laws of the State of Florida. If any provision is held invalid, the remaining provisions remain in effect.
7. Acknowledgment of Understanding
I have read this Agreement carefully, fully understand its terms, and sign it freely and voluntarily.
8. Cancellation Policy and Team Payment Terms
Cancellation Policy
- Lesson, clinic, or program cancellations must be made at least twenty-four (24) hours prior to the scheduled start time.
- Cancellations made less than 24 hours in advance may be charged in full or forfeited.
- This policy does not apply in cases where KL Tennis cancels due to unsafe weather conditions or other circumstances outside the participant’s control, in which case rescheduling or credit may be provided at KL Tennis’ discretion.
Team Participation Payments
- Registration and payments made for team participation or seasonal team clinics are non-refundable, as placement secures a roster position and reserves coaching and court resources in advance.
- By committing to a team and submitting payment, I acknowledge that these fees are final and not subject to refund, except where required by applicable law.
